Terms and Conditions of DBS Credit Card These Terms and Conditions of DBS Credit Card Facility ("Credit Card Terms and Conditions") shall apply to Cardholders whose application for DBS Credit Card facility has been approved. Please read these Credit Card Terms and Conditions carefully.
DEFINITION AND INTERPRETATION
Unless the context requires otherwise, the following terms contained in these Credit Card Terms and Conditions shall be interpreted and have the meaning as follows:
"Acquirer" means banks or non-bank institutions that collaborate with Merchants that are capable of processing Card data issued by other parties or, in this case, the Bank.
"DBS digibank Application" means the electronic banking service provided by the Bank which enables Users to use banking services via mobile phone.
"Credit Card Facility Application" means application form of DBS Credit Card facility which is filled in and signed by the Cardholder.
"Digital Application of Digital Credit Card" means the electronic banking service for application of DBS Credit Card facility which is filled in and approved digitally by the prospective Cardholder.
"ATM" means ATM (Automated Teller Machine) service belonging to the Bank and/or other banks operating in the network that is capable of accepting the Cards to carry out transactions.
“Bank ” means PT Bank DBS Indonesia, a banking institution that is licensed and supervised by the Financial Services Authority (OJK) and Bank Indonesia (BI).
"DBSI Customer Center" means telephone numbers set down by the Bank and communicated to the Cardholders through the channels commonly used by the Bank, namely 0804 1500 327 or +62 21 298 52888 (from abroad).
"Bank DBS Indonesia Website" means the official webpage of Bank DBS Indonesia which provides information and access to the products and services offered by Bank DBS.
"DBS Credit Card" or "Card" means any credit card issued by the Bank in the name of the Cardholder, both Primary Card and Supplementary Card, including credit cards previously issued by PT Bank ANZ Indonesia which were acquired by the Bank and have been changed to the DBS Credit Card.
"Primary Card " means a Credit Card issued by the Bank to the Primary Cardholder.
"Supplementary Card" means a Credit Card issued by the Bank to the Supplementary Cardholder.
"Physical Credit Card" means a DBS Credit Card printed by the Bank in the name of the Cardholder or the Supplementary Cardholder.
"Digital Credit Card" means a non-physical/digital DBS Credit Card issued by the Bank in the name of the Primary Cardholder specifically for application submitted via Digital Credit Card Application. This Digital Credit Card can only be accessed via DBS digibank Application and can only be used to carry out online transactions."DBS Cashline" means a personal loan product with the option of fixed installment loan features and/or revolving loan with an accrued interest rate, the withdrawals of which can be made using a Card, by contacting the DBSI Customer Centre, or using the DBS digibank Application.
"Under Special Mention Credit Quality" means a Card Account with outstanding bill payment of 1 day up to 90 calendar days.
"Doubtful Credit Quality" means a Card Account with outstanding bill payment of 120 up to 179 calendar days.
"Substandard Credit Quality" means a Card Account with outstanding bill payment of 90 up to 120 calendar days.
"Pass Credit Quality" means a Card Account with bill payment that has met or exceeded the Minimum Amount Due and have been received by the Bank on or before the Payment Due Date.
"Loss Credit Quality" means a Card Account with outstanding bill payments of more than 180 calendar days.
"Direct Debit Authorization" means the authorization given by the Customer to the Bank to carry out direct debit for Credit Card payment. The said Direct Debit Authorization shall include the authorization that the Customer has given to PT Bank ANZ Indonesia for the payment of credit card issued by PT Bank ANZ Indonesia which is then acquired by the Bank.
"Digital Credit Card Purchase Limit" means the credit limit that a customer can use to make transactions using the Digital Credit Card. The Digital Credit Card purchase limit only applies to the Digital Credit Card and it is updated every Billing Statement Date.
"Combined Credit Limit" means the maximum amount of credit card facility approved by the Bank for all DBS Credit Card accounts, including DBS Cashline Card, and any changes thereto from time to time.
"Billing Statement" means a statement printed on each monthly Statement Date containing information of the Transactions carried out by the Customer, including information of interests and fees charged in connection with the Transaction.
"Loan on Card (LOC)" means a feature of cash fund provision for the Cardholders taken from the Combined Credit Limit to be transferred to a Bank account designated by the Cardholder, as long as the name on the account matches the name of the Cardholder. The LOC is paid using fixed instalment method in accordance with the agreed interest and instalment tenor.
"Merchant " means any shop/company/other party that accepts your Credit Card for purchasing goods and/or services.
"OJK" means the Financial Services Authority.
"Cardholder" or "Customer" means the Primary Cardholder and Supplementary Cardholder.
"Supplementary Cardholder" means a person designated by the Primary Cardholder to obtain a Supplementary Card to be issued by the Bank.
"Primary Cardholder" means the authorized user of the Primary Card (Card applicant via the Credit Card Facility Application approved by the Bank) and the DBS Credit Card account holder.
"PIN" means "Personal Identification Number" used as a substitute for a signature for all goods purchase and cash advance transactions made domestically and abroad using a Physical Credit Card.
"Card Account" means an account that can be accessed using your Credit Card.
"Banking Account" means a savings account or current account.
"Balance Past Due" means the total amount due (principal, interest, fees, and insurance premiums (if any)) on the DBS Credit Card.
"SLIK" means Financial Information Services System.
"Statement Date" means the date on which all Customer Transactions are calculated, including the calculation of interest and fees incurred and the Billing Statement is printed. The Statement Date will be stated on the Billing Statement.
"Payment Due Date" means the deadline by which the instalment payment shall be received by the Bank. The Payment Due Date will be stated on the Billing Statement.
"Minimum Amount Due" means the minimum amount that the Cardholder must pay as stated on the Billing Statement no later than the Payment Due Date.
"Total New Balance" or "New Balance" means the amount that the Customer must pay for the Customer Card at a certain time, and which will be billed to the Customer in the monthly Billing Statement.
"Transaction" means all financial transactions relating to the Card Account.
"Purchase (Retail) Transaction" means valid Purchase (retail) Transactions at the Merchant who accepts Mastercard/Visa Credit Cards/other card brand holders who collaborate with Banks, all over the world.
"Cash Advance Transaction" means the use of a Card for cash advance at all ATMs bearing the logo of Mastercard/Visa/PLUS/other Principals/ATM Network that collaborate with the Bank, either in Indonesia or abroad.
1. CARD AND PIN OWNERSHIP The card will always belong to the Bank and given to the Customer to use in accordance with the terms and conditions set out in the Credit Card Terms and Conditions. The Card can only be used by the Customer subject to the terms and conditions set out in the Credit Card Terms and Conditions. The Customer must be responsible for all use of the Card.
The Customer shall be responsible and undertake to keep the Card properly and securely, and immediately report verbally or in writing to the Bank if his Card is lost or stolen or misused (fraud).
The Customer must take all necessary measures to ensure the security of the PIN. The Customer shall not write down the PIN on the Card or keep the PIN in a written note. The Customer is not supposed to inform his PIN to anyone, including the Bank.
The Customer agrees and undertakes to be responsible for all Transactions made using the DBS Credit Card in which verification has been carried out with respect the validity of the Customer's PIN. When the Bank delivers the Card to the Customer, if the Customer is not available and unable to receive the Card, the Bank may ask for approval from the Customer to deliver the Card to another person at the same Customer's address registered in the Bank system.
2. CARD VALIDITY PERIOD, REPLACEMENT AND/OR RENEWAL The Card shall be valid through the validity period stated on the face of the Card. The validity period of the Card shall begin on the date the Card is issued by the Bank and expire on the last day of the deadline month stated on the face of the Card. The validity period of the Card also expires if the Customer or Bank close the Card.
Unless the Customer violates a condition stipulated in these Credit Card Terms and Conditions, the Bank will automatically renew the Card's validity period and send a new Card, generally within 2 (two) months before the Card's validity period expires. For new Cards, the Customer must activate and create a PIN via the Bank DBS Indonesia website/DBS digibank Application. If the Customer does not receive a new Card or replacement Card at least within 15 (fifteen) calendar days from the expiry date of the Card, the Customer may contact DBSI Customer Center.
Customer who does not intend to renew the Card's validity period must notify the Bank at least 45 (forty five) calendar days before the end of the Card's validity period via the DBSI Customer Center. If the Customer does not provide this notification, the Bank will continue to renew the Card and charge any fees related to the Card (as stated in Article 24) which the Customer must pay.
3. LOST, STOLEN, OR MISUSED (FRAUD) CARD AND PIN DISCLOSED The Customer must immediately notify the Bank by contacting DBSI Customer Center, and request the Bank to block the Card, if Customer's Card PIN is actually or allegedly disclosed to any third party, or the Card is lost or damaged or misused (fraud) by another unauthorized person. After making this request, the Customer can no longer use the Card for any transactions and the Bank will immediately block the Card.
The Bank will record the loss, theft, and/or misuse (fraud) of the Card by another unauthorized person, and/ or disclosure of the PIN and take the necessary actions to prevent misuse (fraud) of the Card and/or PIN upon receiving the notification and request.
If the Customer has notified the Bank, the Customer shall have no further responsibility for any unauthorized Card Transactions, to the extent that the Customer is not involved in or caused the loss, theft, and/or misuse (fraud) of the Card, and/or disclosure of the PIN, is not involved in the fraud, and/or unauthorized Card Transactions arising from or in connection with the loss/ theft of the Card or disclosure of the PIN.
The Customer is required to bear full responsibility for any losses incurred by the Bank, including but not limited to bills from fixed instalments and/or cash withdrawals and/or misuse (fraud) of DBS Credit Card that has occurred in connection with any loss, theft, or misuse (fraud) of the Card that has not been reported verbally or in writing to the Bank, which has resulted in the Bank not blocking the lost Card.
The Bank has the right to charge the Customer a fee for the issuance and delivery of the replacement Card. If the Customer finds the Card again, the Customer shall not use it and immediately destroy the Card.
If further documents that confirm the occurrence of the event mentioned above ("Loss Event Documents") for transaction investigation are required, such as a police report, the Customer must immediately send these documents to the Bank. The Loss Event Documents must be provided to the Bank according to the time specified by the Bank. The Customer may send the Loss Event Documents to the Bank via mail, email to the Bank's correspondence address, or other channel determined by the Bank.
4. DIGITAL CREDIT CARD After the application form of DBS Credit Card via the DBS digibank Application is approved by the Bank, the Customer will get two types of credit cards, namely a Digital Credit Card and a Physical Credit Card (plastic). Digital Credit Card is only issued to the Primary Cardholder that have different card number from that of the Physical Credit Card. Customers can directly use their Digital Credit Card for transactions after successful activation by accessing the digital card credentials through the DBS digibank App. The Customer can use Digital Credit Card for online transactions, e-wallet or other transactions as informed by the Bank from time to time.
The Customer is fully responsible for maintaining and keeping the Digital Credit Card credentials confidential and is willing to bear all risks and consequences arising from the use of the Digital Credit Card as set forth in point 3 (three) of the Credit Card Terms and Conditions mentioned above.
Digital Credit Card and Physical Credit Card shall refer to 1 (one) same Customer Card Account. All Digital Credit Card transactions will be credited to the combined Billing Statement for the Customer Card Account.The Bank may terminate (permanently deactivate) the Digital Credit Card based on the results of the periodic review if there are no transaction activities for six (6) consecutive months, in accordance with applicable regulations. Customer may continue to use their Physical Credit Card for both online and offline transactions.
5. DIGITAL CREDIT CARD FEES AND TARIFF The Digital Credit Card is not subject to an annual fee. The interest, fees and other tariff charged for digital Credit Card shall comply with interest, fees and tariff applicable to DBS Credit Cards.
6. DIGITAL CREDIT CARD PURCHASING LIMIT The Digital Credit Card Purchasing Limit is a part of the Combined Credit Limit of the Customer Card Account. The Customer may at any time set the desired Purchasing Limit, in which the maximum Digital Credit Card Purchasing Limit is the Combined Credit Limit of the DBS Credit Card provided by the Bank. Any Digital Credit Card transactions can only be processed if the Combined Credit Limit of the Customer Credit Card and the Digital Credit Card Purchasing Limit are still available. The Customer is required to ensure that the Purchasing Limit is available in order that the Digital Credit Card transactions are not hampered.
The Digital Credit Card Purchasing Limit will be updated monthly every Billing Statement Date. The available Combined Credit Limit of Credit Card will not affect the Digital Credit Card Purchasing Limit but may affect the Digital Credit Card transaction authorization. For example, if the Combined Credit Limit of the Credit Card has been used up, the Digital Credit Card cannot be used for any transactions, although the Purchasing Limit stated in the application is still available (as seen in Illustration 2). Changes to the Digital Credit Card Purchasing Limit can be made via the DBS digibank Application.

The Customer has a Combined Credit Limit from the DBS Credit Card of IDR10,000,000, and the Digital Credit Card Purchasing Limit is set at IDR2,000,000. Thus, the total transaction that can be made using a Digital Credit Card per month is a maximum of IDR2,000,000.00. If the Customer makes a transaction above IDR2,000,000, the transaction will be rejected.

The Customer has a Combined Credit Limit from the Credit Card of IDR10,000,000, and the Digital Credit Card Purchasing Limit is set at IDR2,000,000. The Customer makes a transaction using the Physical Credit Card (plastic) totalling IDR10,000,000. Thus, the Customer is unable to make transaction using the Digital Credit Card until the Customer makes a payment to the Credit Card, because the Combined Credit Limit of the Customer’s DBS Credit Card is no longer available.
7. SUPPLEMENTARY CARD At the request of the Primary Cardholder, the Bank may issue a Supplementary Card to anyone aged more than 17 years or who has been married in accordance with the application of the Primary Cardholder. Each Primary Card may have up to 3 (three) Supplementary Cards which have a different number from the Primary Card and the Limit is subject to the Combined Credit Limit.
The Primary Cardholder shall be bound by the use of Card by the Supplementary Cardholder(s) and shall be responsible for any bills, fees and expenses arising from the use of the Supplementary Card and the Bank has the right to bill all such bills, fees and expenses through the Customer Card Account.
The Bank is entitled to cancel any or all Supplementary Cards issued to the Customer by giving notification to the Primary Cardholder. In addition, at the request of the Primary Cardholder, the Bank shall cancel all Supplementary Cards. However, all transactions that have been made using the Supplementary Card shall be valid and binding on the Primary Cardholder until all amounts due on the Card have been paid.
The Customer who intends to provide Supplementary Cards to the family members or Customer’s associates may visit the Bank's official website for application submission.
8. COMBINED CREDIT LIMIT
The Combined Credit Limit of DBS Credit Card is the maximum amount of funds that the Customer can use and will be given at the Bank's absolute discretion, taking into account the risks and applicable statutory provisions.
In correlation with the DBS Credit Card application process via the DBS digibank Application, the Customer will be given an initial Combined Credit Limit during the DBS Credit Card application process with reference to the Bank's internal policies. The Bank may adjust the initial Combined Credit Limit after making a thorough examination of the DBS Credit Card and DBS Cashline application, and by referring to the Bank's internal policies. If the Customer does not fulfill with the Bank's internal policies, the Bank is entitled to reduce the Combined Credit Limit and/or close the DBS Credit Card and DBS Cashline facility. The Customer is required to check the latest Combined Credit Limit provided by the Bank via the DBS digibank Application.
The Bank has the right to at any time increase or decrease the Combined Credit Limit (with or without prior request from the Customer), as long as it is permitted by the applicable statutory provisions.
The Combined Credit Limit can be reduced or cancelled at any time by the Bank including but not limited to if the Customer's credit quality in the Bank's system or in the OJK’s SLIK Report degrades into substandard, doubtful or loss. The Bank also has the right to set down a separate limit for cash advance and cash transfer transactions (in the total Combined Credit Limit of the Customer's DBS Credit Card) and has the right to determine a certain Combined Credit Limit for the Customer's DBS Credit Card. The Bank will notify the Customer of any changes to the Combined Credit Limit. The Bank has the absolute right to accept or reject the DBS Credit Card transactions that will or has exceeded the predetermined Combined Credit Limit.
The Bank may also at any time change or increase the Combined Credit Limit of the Customer's DBS Credit Card and DBS Cashline if the condition or performance of the Customer's credit is deemed good by the Bank. The Bank also has the right to determine the maximum limit for increasing the Customer’s Combined Credit Limit.
In the event that the Combined Credit Limit which will/ has been provided by the Bank is equal to or exceeds a certain limit regulated under the provisions of the prevailing laws and regulations, the Bank may require the Customer to submit a copy of the latest Taxpayer Identification Number (NPWP) relating to the effectiveness of the Combined Credit Limit
9. AVAILABLE COMBINED CREDIT LIMIT The available Combined Credit Limit of the DBS Credit Card is the Limit that has not been used from the Combined Credit Limit that has been provided by the Bank to the Customer at a certain time. The available Combined Credit Limit will be calculated by taking into account the Combined Credit Limit, Balance Past Due, and fees or Transactions that have been received and processed by the Bank.
The Bank, with due observance of the provisions of the applicable banking regulations, may determine Combined Credit Limit separately for (retail) Purchasing Transactions and Cash Advance Transactions, and will notify these limits from time to time. The Customer is responsible for all activities with regard to DBS Credit Card and DBS Cashline, and must always ensure that the use of DBS Credit Card and DBS Cashline remains within the available Combined Credit Limit.
10. PRIVILEGES AND FACILITIES The Bank will from time to time establish collaborations with various agents including Merchants to offer privileges and additional benefits for the Cardholders. Although all these arrangements will be made on best efforts basis, the Bank does not guarantee and is not responsible for the products or services offered by third parties, as long as they are not caused by gross negligence and wilful misconduct of the Bank. Any disputes (if any) must be resolved by the Cardholder directly with the agent or Merchant.
11. ACCEPTANCE The Card will be accepted at the Merchant if the back of the Card bears the signature of the Cardholder specifically for card types that have a signature panel/stripe whose name appears on the Card. The Card will be accepted at any Merchant that displays a Card logo that matches the Customer's Card (Mastercard or Visa). However, the Bank is not responsible for or shall not be liable to any obligations resulting from the Merchant's refusal for any reasons whatsoever and for any actions or losses that create an unpleasant circumstance for the Customer to the extent that it is not caused by gross negligence and wilful misconduct of the Bank..
The Customer may report to the Bank if there is a refusal or action of or loss caused by a Merchant by stating the Merchant's name, date and time of the incident and all information that will assist the Bank in carrying out investigation by contacting DBSI Customer Centre.
By inputting the PIN, signing the Transaction slip, or making contactless transaction, the Customer is responsible for the amount, receipt of goods, services, or cash (in some possible cases), including all fees or service charges listed in the document. A copy of the Transaction slip given to the Customer must be kept at least until the Transaction appears on the Billing Statement for adjustment.
The Credit Card is only valid for use as a means of payment for retail transactions and cash advance transactions at ATMs. The Card shall not be used to withdraw money from the Merchant or for any unlawful purposes, including but not limited to purchasing goods and services that are prohibited by the prevailing laws and regulations in the Republic of Indonesia or the applicable laws in the jurisdiction where the Card is used.
12. VISA PAYWAVE/MASTER PAYPASS FACILITIES Visa payWave or Master PayPass is a feature by simply waving the Visa or Mastercard card in front of the Visa payWave or Master PayPass card reader at the cashier. Visa payWave or Master PayPass card is equipped with contactless payment technology, bearing a unique contactless symbol on the card. Visa payWave or Master PayPass card has a chip embedded therein, which contains a small antenna that transmits payment instruction signals securely to and from the Visa payWave or Master PayPass card reader. Visa payWave or Master PayPass card can be used to carry out transactions at all Visa payWave or Master PayPass card reader terminals and at other readers or systems approved by the Bank from time to time.
The Visa payWave or Master PayPass card reader is a device for carrying out transactions by waving a Visa payWave or Master PayPass Card. This transaction does not require a signature, PIN or other authentications from the Customer for a certain transaction amount.
The Customer may make Purchasing (retail) Transactions on Visa payWave or Master PayPass card reader by simply waving the card. For contactless transactions in Indonesia, transactions without a PIN can be made with a maximum amount of each transaction of IDR 1,000,000 (one million Rupiahs). If the transaction value is above IDR 1,000,000 (one million Rupiahs), the Customer needs to wave the card and enter the PIN on the Visa PayWave or Master PayPass card reader.
Contactless transactions made abroad shall refer to the regulations applicable in each country
13. CASH ADVANCE The Customer may make cash advance from the Card Account up to 50% of the Combined Credit Limit determined by the Bank, via Bank ATMs or ATM networks collaborating with the Bank. To make cash advance via ATM with a card with chip technology, there is a maximum daily cash advance limit equivalent to IDR 15,000,000 (fifteen million Rupiahs) per business days.
The Customer acknowledges the full responsibility for all transactions processed using the Card at the ATMs and hereby authorizes the Bank to debit the Customer's DBS Credit Card according to the amount withdrawn with or without the Customer's knowledge.
Bank Transaction Records that are processed from the use of a Card at the ATMs shall determine and be binding for any purposes. The Bank is not responsible for all losses or damages arising either directly or indirectly from the non-functioning/failure of the Card or ATM, temporary insufficient funds at the ATM or any other matters that arise due to the Customer's faults in using the Card or ATM. The Customer is not entitled to make withdrawals exceeding the available Combined Credit Limit for cash advance transactions. In addition to cash advance at the Bank’s ATMs, cash advance may result in administration fees in accordance with the regulations set down by the bank that owns the ATMs or the ATMs network.
Banks that provide cash advance using Card via ATMs may set down a minimum and/or maximum transaction limits that the Customer must aware and understand before making transactions.
In the event of an objection of a Card Transaction that was not carried out by the Customer, the Bank may carry out further investigations to investigate the objection. The Customer is required to send a written objection for further substantiation and, if necessary, submit the relevant Card for further substantiation. With respect to a Card Transaction caused by Card counterfeiting (specifically Card counterfeiting or duplication) which has been confirmed by the Bank, the Customer is released from the obligation to make payments for the Card Transaction, and it will be charged on/borne by the Bank.
Upon a cash advance made by the Customer, the Customer acknowledges that he has owed the Bank amounting to the principal loan (debt) plus interest and other fees payable by the Customer to the Bank.
14. TRANSACTIONS ABROAD If you make a transaction in foreign currency, the transaction will be converted to Rupiah. The conversion will be made on the date the transaction is processed by Mastercard/Visa International which may be different from the date the transaction occurs. The exchange rate used subject to the provisions applicable to Mastercard/Visa International with a surcharge applicable at DBS.
The Cardholder is responsible for all transactions, including all risks that occur if there is a difference in exchange rates in reimbursing and/or cancelling transactions using foreign currency. The obligation of using a PIN for transactions abroad shall refer to the regulations applicable in each country.
Transactions carried out by the cardholder at any merchant using the Merchant Country Code of Austria, Belgium, Bulgaria, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Iceland, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden, the United Kingdom, Liechtenstein, and Norway will not earn DBS Rewards Points/Mileage.
15. TRANSACTIONS CHANGED INTO INSTALLMENTS The Customer may apply to change a Purchasing (retail) Transaction with revolving interest into a Transaction with fixed instalments via the DBSI Customer Center or the DBS digibank Application. The Customer may apply for such changes no later than 30 (thirty) calendar days after the posting date of the transaction. The Bank may also at any time offer the Customer to change the Transaction into fixed instalments in accordance with the Bank's policies and criteria. Specifically for Purchasing Transactions with Digital Credit Card, these transactions can be changed into transactions with fixed instalments via the DBS digibank Application after the Customer activates the Physical Credit Card.
The fixed instalment feature allows the Customer to choose the instalment tenor in accordance with the Bank's provisions. Any transaction that is changed into instalments will be subject to interest and conversion fees. Each instalment will be charged to the Customer's DBS Credit Card. Information regarding the Customer's instalments will be printed on the Billing Statement. Other interest and late payment fees will be charged on instalments that are past due and other late payment amounts which have been calculated in accordance with these Credit Card Terms and Conditions. The instalment tenor that has been selected cannot be changed. Further information regarding detailed instalment interest calculation is listed on the website at go.dbs.com/id-bungacicilan. Reward or mileage points from (retail) Purchase Transactions that are changed into instalments will be cancelled effectively after the Transactions are successfully converted into instalments. If an instalment transaction is cancelled, the Customer will be charged a cancellation fee which applies at the time of the instalment transaction cancellation and there will be no refund of reward or mileage points.
The Bank, at its own discretion, may charge a cancellation fee or an early repayment fee of the fixed instalments on the Customer's DBS Credit Card if the Customer cancels and/or pays off the loan early for Transactions using fixed instalment method on the DBS Credit Card.
With respect to cancellation or early repayment of the fixed instalment feature of the DBS Credit Card, the Customer must inform the Bank by telephone to the DBSI Customer Center. Otherwise, the Bank will continue calculating the fixed instalments of the Customer's DBS Credit Card.
16. PAYMENT All payments to the Customers Card Account must be made in Rupiah currency. The Minimum Amount Due on the Customer's Billing Statement will be due on the Payment Due Date
The Customer is required to make a payment of not less than the Minimum Amount Due stated on the Customer's Billing Statement and such payment shall be received by the Bank no later than the Payment Due Date or on the next business day if the Payment Due Date falls on a holiday. Any amount that has passed the Payment Due Date or exceeded the Combined Credit Limit stated on the Billing Statement must be paid promptly. If the payment made is less than the Total Amount Due and/or past the Payment Due Date, the unpaid bill will be subject to the applicable Interest and Late Payment Fee. Any payment made by the Customer via bank transfer (LLG/SKN) shall be processed under the procedures of transfer period from the relevant sending bank and received by the Bank at the latest two (2) business days since the date the payment is made.
The Minimum Amount Due is calculated based on a certain percentage, namely 5% of the total new bill, plus 5% of the fixed instalments. The amount that exceeds the Combined Credit Limit and any amount that is overdue from your previous Billing Statement will be notified by the Bank from time to time in the Billing Statement. With respect to the payment, with a minimum of 5% of the Total Bill or more but not full, will be allocated as follows:
Fees and fines on the Customer Credit Card. At least 60% of the payment balance (after deducting fees or fines as referred to in point 1 above) will be allocated for payment of the transaction principal. The payment balance (after deducting fees or fines as referred to in point 1 above and payment of the transaction principal as referred to in point 2 above) will be allocated for other payments, for instance for interest payment. Any excess payment (after settling the above matters) will be posted as a credit on the Customer Card Account. Any excess payments can be claimed referring to the provisions of the applicable regulation. For further information regarding terms and conditions of excess payment claim, please contact DBSI Customer Centre.
The Bank is not responsible for any disputes resulting from shortages and/or defects in the services and/or goods purchased and will not provide compensation and/or accountability in any form whatsoever, so that the Customer remains obliged to make payments as billed by the Bank.
17. THE CUSTOMER’S CREDIT QUALITY The Bank classifies the Card Account credit quality based on payments made by the Customer into Pass Credit Quality, Under Special Mention Credit Quality, Substandard Credit Quality, Doubtful Credit Quality, and Loss Credit Quality.
In accordance with the applicable banking regulations, the Bank implements a single debtor policy, in which the credit quality of the Primary Cardholder reflects the credit quality of the Supplementary Cardholder with the lowest credit quality between the Primary Cardholder and the Supplementary Cardholder as determined by the Bank. If the Cardholder has more than 1 Primary Cards, the lowest credit quality of any of the Primary Cards will be used by the Bank.
18. BILLING STATEMENT, STATEMENT DATE, and PAYMENT DUE DATE The Customer will receive a DBS Credit Card Billing Statement each month via electronic mail (email) to the Customer's email address registered within the Bank's system or via physical mail to the Customer's correspondence address registered within the Bank's system. If the Customer requests that the Billing Statement be sent by mail, the Customer will be charged a printing fee. Information about Customer’s monthly billing statement can also be obtained at any time via the DBS digibank Application, ATM, or DBSI Customer Center.
The Bank will include all Transactions related to the Supplementary Card(s) on the combined Billing Statement for the Customer Card Account.
If there are no Amount Due and no Transactions have been received by the Bank since the last Billing Statement, the following Billing Statement will not be issued and sent.
Statement Date is determined by the Bank. For information related to the Statement Date, the Customer may contact DBSI Customer Centre.
Payment Due Date for the DBS Credit Card is 16 (sixteen) calendar days commencing from the Statement Date. If the Payment Due Date for the relevant month falls on a Saturday, Sunday and/or other holidays, the Bank will set the Payment Due Date on the next business days.
If the Customer does not receive the Billing Statement within 12 days as of the Statement Date, the Customer is responsible for contacting the Bank to confirm the amount due to the Customer and the Customer must immediately make payment because not receiving the Billing Statement is not a valid reason for not making the payment of at least the Minimum Amount Due before the Payment Due Date. To avoid the risk of late payment charge, the Bank recommends that the Customer always make payment no later than 3 (three) business days before the Payment Due Date.
If there are any discrepancies on the Billing Statement, the Customer must contact the Bank to file an objection no later than 30 calendar days as of the date the Billing Statement is issued.
19. DIRECT DEBIT FACILITY After the Customer has given Direct Debit Authorization, the Bank will debit the Customer's Banking Account periodically on the Payment Due Date of each monthly bill, up to the selected amount. The Bank will debit whatever amount of funds is available in the Customer's Banking Account if the available funds are lower than the Customer's preferred payment amount.
The Bank will not notify the Customer separately regarding the direct debit transaction to be processed and it is the Customer's responsibility to ensure that there are sufficient funds in the Customer's Banking Account with the Bank registered for direct debit instruction feature on the Payment Due Date.
The Bank will inform the Customer if the direct debit process fails or is only partially successful and may charge for this reason the fees if the funds in the Customer's Banking Account are insufficient to pay the entire amount of the selected direct debit instruction. The Bank will not repeat a failed direct debit transaction.
20. TRANSACTION DISPUTES The Customer may submit an objection statement and/or request for correction to the transaction in writing, no later than 30 (thirty) calendar days after the Statement Date. The Bank has the right to approve or reject the Customer's request/objection at the latest within a period of 10 (ten) Business Days after the submission of the request/objection, and under certain conditions, such term may be extended for a maximum of 10 (ten) business days from that time. The objection statement and/or request for correction to the disputed transaction must be signed by the Customer whose name is specified on the Card used to make the disputed transaction and the Primary Cardholder (in the case of the disputed transaction is made using a Supplementary Card) and the signed statement must include the following information ("Transaction Dispute Information"):
Customer Name, Customer Card Number, Nature of the disputed transaction, by enclosing, a copy of the transaction record, if any, Transaction value, The Bank shall make efforts to provide a response to the Customer within 20 (twenty) business days upon the receipt of the objection statement and/or request for correction of the transaction complete with the Transaction Dispute Information. The Bank is entitled to approve or reject the objection statement and/or request for correction of the transaction. If the Bank determines that an error on the Bank's part has occurred, the Bank will correct the error (to the extent possible) and pay back all interest or fee that have been charged to the DBS Credit Card caused by such error. The Bank shall not be responsible for any further consequences of the error to the extent that it is not caused by gross negligence and wilful misconduct of the Bank.
21. AUTHORIZATION BY TELEPHONE OR OTHER MEDIA The Customer authorizes the Bank to rely on and act in accordance with any notification, instruction, request, or other communication that may be given via telephone Transaction or other media (which can be reconfirmed by the Bank) by the Customer and the Bank is entitled to treat such instructions as instructions which is fully authorized by the Customer so that the Bank has the right to take steps in accordance with the instructions as deemed appropriate by the Bank.
For the Bank's sole consideration, the Bank is not required to accept and to take actions on these instructions, including but not limited to the following matters:
Changes to the mandate (payment order), Changes to the authorized signatory, Authorization to other persons/entities, Closing accounts and transferring balances in any manner whatsoever, Changes to the Customer’s data, Changes to the DBS Credit Card data, Card issuance, replacement, and blocking. In connection with instructions via telephone, the Customer hereby authorizes the Bank:
To record, monitor, and trace every telephone conversation between the Customer and the Bank in the Bank's internal interests. To verify the authenticity of the caller by asking the caller to provide information regarding the Customer's DBS Credit Card facility so that the Bank can determine the authenticity of the caller to obtain information on the relevant DBS Credit Card facility and to provide instructions to the Bank. To make an oral agreement as an official record that has the same status as a written agreement. By considering the Bank's actions according to the terms of this authorization, the Customer undertakes to indemnify the Bank against any losses resulting from any legal actions, consequences, requests, damages, costs, and expenses incurred or suffered by the Bank of any nature whatsoever and which occur resulting from any party whomsoever or resulting from such instructions. This authorization shall remain valid with full effect unless and until the Bank receives and approves in writing a termination notification from the Customer.
22. MANDATES To further guarantee orderly repayment of any amount payable by the Customer to the Bank, including the principal debts, interest, and fee (if any) in connection with the DBS Credit Card, the Customer hereby gives mandates to the Bank that cannot be revoked for any reasons whatsoever to act in the name of the Customer to disburse all of the Customer's assets in any forms whatsoever that are administered by the Bank or to charge other accounts of the Customer that are also administered by the Bank, for the purposes of paying off the Customer’s debts to the Bank.
These mandates shall be irrevocable and cannot be terminated for any reasons whatsoever to the extent that the debts of the Customer to the Bank have not been fully settled and constitute an important and inseparable part of the Credit Card Terms and Conditions. The Customer hereby agrees to waive all regulations contained in the law including articles 18131 , 18142 , and 18163 of the Indonesian Civil Code and all provisions that cause a termination of a mandate.
1 A mandate is terminated
Due to revocation of the mandate granted to the mandatory; Due to a notice of termination of the mandate by the mandatory; Due to the death, the guardianship, the bankruptcy or apparent insolvency, either of the mandator or the mandatory; Due to the marriage of the woman who has granted or accepted the mandate.
2 The mandator may revoke the authority if he deems fit, and if there are grounds therefor, he may require the mandatary to return the mandate.
3 The appointment of a new mandatory for the performance of the same function, is cause the revocation of the appointment of the first mandatory, effective as of the date of notification of the appointment to the latter mentioned
23. INTERESTS If the total amount due is not paid in full or the payment is effectively received after the Payment Due Date or there is no payment at all, the Customer shall be charged interest (also known as finance charges or billed deferred) of 1.75% per month or 21% per year which will be calculated for each type of (Retail) Purchasing Transaction and Cash Advance Transaction, from the posting date, which is the actual date the Bank makes payment to the Acquirer on the basis of the Transaction carried out, the interest expense will be calculated until the date of full payment, calculated on the basis of the daily balance and will be adjusted to the payments made by the Customer and received by the Bank. The Bank does not include interests, fees, and fines payable as components in calculating credit card interest.
The daily interest shall be determined based on calculation of the number of calendar days in 1 year, namely 365 days. That is included in the interest rate calculation are as follows:
Calculation of Interest on (Retail) Purchasing Transactions Interest on Purchasing Transactions will be calculated from the posting date. The interest on Purchasing Transaction will be charged if the payment is not received by the Bank on the Payment Due Date, payment is not made in full, or payment is received by the Bank after the Payment Due Date. Calculation of interest on Purchasing Transactions for the next billing is made on the balance of the bill for the unpaid Purchasing Transaction.
Calculation of Interest on Cash Advance Transactions The interest is calculated and charged from the posting date of the Cash Advance Transaction until the date of full payment of the cash advance amount plus interest. The interest will be calculated based on daily bills for adjustment to partial payments (Cash Advance Transaction fees will be charged based on this partial payment).
Formula for Calculating Interests on Purchasing and Cash Advance Transactions:
Interest period (day) is the number of days from the posting date of the transaction until the date of full payment.

Calculation of Interest on Loan on Card Transactions Loan on Card transaction will be posted first using a retail transaction scheme, and then it is converted into instalment.
Between the transaction posting date and the instalment conversion date, the interest will be calculated using the Calculation of (Retail) Purchasing Transaction Interest, which will be charged if the payment is not received by the Bank on the Payment Due Date, the payment is not made in full, or the payment is received by the Bank after the Payment Due Date.

Note:
Interest on the retail transaction made on July 30th (IDR 2,000,000) will be charged in the following month (September) if full payment is not made or there is no payment at all for the July’s bill.

Interest write-off if there is an error in charging interest. If the request for an interest write-off due to an error in charging interest has been approved by the Bank, the excess funds will be credited back to the Customer's Card Account
24. FEES AND RATES The Customer shall be responsible for the following fees, including but not limited to:
Annual fee for Primary Card/Supplementary Card The Bank will charge the Customer an annual fee, if any. Such fee will be billed on the Billing Statement.
The Bank will charge a late payment fee to the Primary Cardholder if the payment is not received by the Bank on the Payment Due Date, or if it is the closest business day after the Payment Due Date, if the Payment Due Date falls on a holiday, or the Customer makes a payment for an amount of less than the Total Minimum Payment. The maximum late charge is 1% (one percent) of the total bill and does not exceed IDR100,000 (one hundred thousand Rupiahs).
The Bank will charge stamp duty in accordance with the provisions of prevailing laws and regulations
The Bank will charge an administration fee to the Customer for Cash Advance Transactions.
The Bank will charge an administration fee to the Customer for Card replacement.
The Bank will charge an administration fee to the Customer regarding the request for a payment refund.
Billing Statement Printing Fee The fee charged to the Customer for printing and duplicating the Billing Statement.
Fees For Converting Transactions into Instalments The Bank may charge a Fee for Converting the Transaction into fixed instalments for each conversion request, which is approved by the Bank. The fee will be charged by the Bank on the Billing Statement in the following month after the fixed instalment conversion is approved by the Bank. The amount of the fixed instalment conversion fee that must be paid by the Customer is stated on the Billing Statement.
Instalment Cancellation Fees The fees charged to the Customer regarding the cancellation and/or accelerated full payment of DBS Credit Cards for the fixed instalment feature, in accordance with Bank policy.
The Customer shall be required to pay all fees related to fund transfers (transfer fees), if any. These fees will be billed on the Billing Statement in the following month after the funds transfer is made. The amount of transfer fees that must be paid by the Customer is stated in the Billing Statement.
Check/Giro or Direct Debit Dishonor Fees Fees charged to the Customer if payment by cheque/giro or direct debit of the Customer is dishonoured
Fee For Copy of Sales Slip The Bank will charge an administration fee to the Customer for requesting a copy of sales slip.
Service fee charged to the Customers of DBS Credit Card for DBS Credit Card transaction notification service.
A fee charged if your DBS Credit Card usage exceeds the Combined Credit Limit.
Fees and rates charged by the Bank can be changed at any time with prior notification by the Bank. The amount of fees and rates billed to the Cardholders can be accessed via the Bank's website. Details of the fees charged to the Customers are listed on the website, go.dbs.com/id-panduanpembayaran .
If the request for a fee and rate write-off due to an error in charging fees and rates has been approved by the Bank, the excess funds will be credited back to the Customer's Card Account.
25. CHANGES IN INFORMATION The Customer represents and guarantees that all information provided is complete and correct as well as the Customer does not hide the real facts.
The Customer is required to immediately notify the Bank with regard to any changes to the Cardholder's personal and employment data including but not limited to data relating to identity number, home address, home telephone number, mobile telephone number, email address, occupation, office address, office telephone number and income per annum and other information with regard to the Customer's condition. The Customer also agrees to immediately notify the Bank of any changes in the names of the Cardholder(s). Changes to information can be made by contacting the DBSI Customer Center or the DBS digibank Application by complying with the provisions applicable to the Bank.
The Bank is not responsible if the Billing Statement is received by the wrong party because the Customer does not notify the Bank of changes in the information.
If the Customer no longer resides in Indonesia and/or has changed his/her citizenship, the Customer shall be required to notify this matter in writing and that shall be delivered to the Bank's correspondence address as stated in Article 41 or by contacting the DBSI Customer Center. The Bank may, at any time, ask the Customer to update the Customer's latest data.
The Bank may, from time to time, check in any way with regard to the correctness of the data and information provided by the Customer
26. SUBMISSION AND CONSENT TO DISCLOSING INFORMATION The Bank is committed to maintaining the confidentiality and security of the Customer personal data and/or information. Furthermore, the Bank has the right to request from the Customer all information and documents from time to time, including those that may be required under the law and/or agreements with the relevant authorities (local or overseas) with regard to the Customer's tax status.
The Bank and its officials or representatives may disclose the Customer’s personal data, both electronic and non-electronic, in connection with the DBS Credit Card, to parties authorized or instructed in accordance with the laws and regulations prevailing in Indonesia or by court order. The Bank and each of its officials or representatives may also disclose information to (a) any party relating to the assignment or transfer offered; (b) any party with the aim of implementing or protecting the Bank's rights or interests in connection with the DBS Credit Card; (c) any parties in connection with the insolvency process (including bankruptcy) relating to the Customer; (d) government or law enforcement agencies if required or ordered in connection with the DBS Credit Card; and (e) service providers appointed by the Bank in connection with monitoring credit implementation, collecting the DBS Credit Card payments, and data management. In sub-paragraph (a) above, "assignment" includes any assignment or transfer of any rights or obligations of the Bank, any participation, transfer of credit or other risks (in whole or in part) or benefits (in whole or in part) in any form, and included in other contractual relationships in connection with the DBS Credit Card.
The Customers hereby declare that they have read and understood all the information in the Terms and Conditions of the DBS Credit Card and have read, understood, and agreed to the Bank’s Privacy Policy available on the Bank’s website. Furthermore, the Customer grants approval to the Bank and other parties who have access to the Customer’s data, both electronic and non-electronic, in connection with the DBS Credit Card, to process the Customer data in accordance with the prevailing laws and regulations. This approval is granted for the purpose of opening the DBS Credit Card, for commercial/non-commercial purposes, as well as for legal purposes since the process of accepting the prospective Customer and/or after the products and/or services the Customer holds have ended, until such data is no longer required by the Bank.
In connection with the disclosure of Information by the Bank under the Terms and Conditions of this Credit Card, the Customer agrees not to hold the Bank liable for any consequences arising from the disclosure of the Customer's Information to any third party The Customer has the right to complete, update, correct errors and/or inaccuracies in data, obtain access and copies of the Customer’s data, terminate processing, delete and/or destroy the Customer’s data, revoke approval previously given, object to decisions based solely on automated processing that has legal consequences or significant impact, and suspend or restrict the processing of data in a proportional manner through the DBSI Customer Center. The Customer understands that the exercise of these rights must comply with the applicable legal provisions, and that these rights do not limit other rights of the Customer as provided for in the provisions of the prevailing laws and regulations.
27. USE OF INFORMATION The Bank has the right to enter the Customer's personal data into the Bank's internal marketing list, as well as to provide it to third parties who are business partners and have been bound by the Bank as providers of products/ services to be offered to the Customer in accordance with the agreement approved by the Customer when submitting the DBS Credit Card Application. If the Customer is not willing to receive product/service offers that will be offered to the Customer by the Bank and/or third parties who are business partners and are bound to the Bank, then the Customer can contact the Bank via the DBSI Customer Center to request exceptions and provisions above.
28. DISCLOSURE OF INFORMATION Based on the provisions of prevailing legal provisions and laws and regulations or based on an authorized court order, the Bank has the right to disclose information with regard to personal data, transactions and Customer credit quality to the Banks or financial institutions that provide credit card facilities or to information management centers organized by the OJK or to credit bureaus including but not limited to banks and/or any parties whose aim is to implement or protect the Bank's rights or interests in connection with DBS Credit Cards and data managers.
If there is a DBS Credit Card bill that is past due, the Bank also has the right to contact and disclose the said information to a third party appointed by the Bank in connection with monitoring the implementation and collection of DBS Credit Card payments and third parties who have a relationship with the Customer, including but not limited to closest family members, people living in the same house, and/or the Customer's co-workers
29. TERMINATION OF DBS CREDIT CARD If the DBS Credit Card terminates for any reason whatsoever, the Bank is not required to provide further DBS Credit Cards to the Customer. All Customer debts to the Bank including interest debts and other fees that arise can be collected immediately and simultaneously (in lump sum) by the Bank and must be paid in full by the Customer.
The Bank and the Customer agree to waive the provisions of Article 1266 of the Indonesian Civil Code insofar as it with regard to the need for a court ruling/verdict in the event of termination of a DBS Credit Card.
30. CLOSURE OF DBS CREDIT CARDS BY THE CUSTOMERS The Customers can apply to close their DBS Credit Card by contacting the DBSI Customer Center (021) 0804 1 500 327 or +62 21 298 52888 (from abroad).
The Bank immediately blocks the card if the Customer applies the closure of the Credit Card Account and then completes the process of the Credit Card closure within 3 (three) business days provided that the Cardholder has completed all its obligations, where the minimum payment provisions become invalid and regardless of the Total Minimum payment due as stated in the Billing Statement, the Customer must pay the Outstanding Balance. The Customers cannot exchange points reward or mileage if the Customer has closed their card.
The DBS Credit Card closure shall be considered to have completed if all the following matters have been done:
The Customer has contacted the DBSI Customer Center and applied to close the DBS Credit Card. All amounts that must be paid to the Bank according to these Credit Card Terms and Conditions have been paid in full (the Customer's balance and the DBS Credit Card must be zero). After the above process is carried out, the Customer shall be obliged to cut the Credit Card at the chip or magnetic strip section.
Under no circumstances, the Bank will not pay back the fees or charges charged on the DBS Credit Card before closure and the Customer shall hereby be obliged to pay all such bills and charges
31. SUSPENSION OR TERMINATION OF DBS CREDIT CARD BY THE BANK If for any reason, the Bank is required to comply with prevailing laws and regulations or requirements set by the relevant authorities (domestic or foreign) or based on the Bank's internal policies, then the Bank, with prior notification to the Customer, may at any time terminate or suspend one or all DBS Credit Cards available to the Customer without the Customer's consent. The Bank also has the right to terminate the DBS Credit Card based on information that the Bank believes could materially affect the Customer's financial condition or other circumstances, in the absolute opinion of the Bank.
In the event of termination as referred above, the provisions of Article 30 shall apply
32. EVENT OF DEFAULT If the Customer fails to pay the Bank any Total Minimum Payment on the Payment Due Date or fails to comply with the Credit Card Terms and Conditions, the Customer agrees that the Bank has the right to do each or all the following matters:
Withholding the redemption of points reward or mileage if the Customer falls under Special Mention Credit Quality. The redemption of points reward, or mileage may only be made if the Customer is included in the Pass Credit Quality. Eliminating the existing points reward or mileage if the Customer is included in Substandard Credit Quality, Doubtful Credit Quality and Loss Credit Quality. Blocking the card, rejecting transactions made by the Customer, or terminating the DBS Card facility, as well as demanding payment and full repayment immediately and simultaneously (in lump sum) from the Customer for the amounts of money owed and the Customer's obligations due to principal debt, interest, fine provisions (if any), and fees that arise and/or will arise based on the DBS Credit Card. The Bank has the right to terminate and demand payment and full repayment from the Customer for the amounts of money owed and the Customer's obligations due to the principal debt, interest, fine provisions (if any), and fees that arise and/or will arise based on the DBS Credit Card, if:
The Customer fails to pay to the Bank:
Instalments/repayment of everything owed by the Customer to the Bank in connection with the DBS Credit Card at maturity. Payment of fees on the DBS Credit Card provided at the time of billing. The Customer is involved in a criminal act or is under the court proceedings or is listed on BI's national blacklist. The Customer is declared negligent or in breach of promise to carry out his obligations based on other credit agreements and other agreements that are still in force, whether made with the Bank or a third party. The Customer stops his business activities and/or no longer has an income source. Any condition or change or series of conditions or changes which in the opinion and assessment of the Bank may have a major or detrimental impact on the business activities or financial condition of the Customer or a detrimental impact on the Customer's ability to repay anything owed to the Bank in connection with the DBS Credit Card. The Customer dies or is put under custody. The Customer: (i) is insolvent or unable to pay his debts, stops, delays or threatens to stop or delays payment of all or most of (or a specific part of) his debts (or any part of his respective debts) that must be paid when due); (ii) submit a bankruptcy petition in any form, if the Customer has filed a bankruptcy petition by any party, or by the relevant court institution is declared bankrupt or for any reason no longer has the right to manage and control his assets; (iii) apply for a postponement of payment (moratorium), or have been appointed as recipient of any of the Customer's property or assets: (iv) propose or make a general transfer (assignment) or arrangement/agreement with or for the benefit of its creditors: and/or (v) the moratorium is approved or declared in relation to or affecting all or part of the basis of (or a specific part of) the debt. If the Customer no longer resides in the city in Indonesia where there is a Bank branch office, but the Customer does not notify the Bank of this matter. If in the Bank's opinion, the Customer has been negligent or has not fulfilled or violated these Credit Card Terms and Conditions. Representations and warranties made and/or submitted by the Customer to the Bank based on the DBS Credit Card Application has been proven to be invalid and/or incorrect and/or incomplete. If the Customer's assets, in whole or in part, are confiscated by the relevant authorities, including a court of law. The legal conduct/action as mentioned above does not prejudice or affect the Bank's right to take all actions or other efforts that the Bank can legally take to demand payment and obtain full repayment of the entire amount owed from the Customer. The Bank may appoint third parties to carry out collection activities until all of the Customer's obligations have been paid in full, subject to the applicable laws and regulations.
33. WAIVER Failure or delay by the Bank to exercise rights, authorities or privileges specifically based on these terms and conditions does not constitute a waiver of those rights, authority, and privileges and the exercise of one or every part of the rights, authorities and privileges in accordance with these terms and conditions, will not stop the continuation of the exercise of such rights or authority or the exercise of other rights, authorities or privileges.
With regard to the DBS Credit Cards originating from Credit Cards issued by PT Bank ANZ Indonesia, at the time of transfer, the Bank will take and use all Customer information provided/transferred by PT Bank ANZ Indonesia including but not limited to information on principal loan (debt), interest, and fees (if any). The Bank is not obliged to verify the correctness of the information provided by PT Bank ANZ Indonesia so that the Bank is not responsible if there are differences in Customer information.
34. LIMITATION OF LIABILITY The Customer hereby agrees to indemnify and hold the Bank harmless against all claims, demands, losses, damages, costs that may arise and be experienced and borne by the Bank in connection with this DBS Credit Card in any case currently and in the future as long as it is not caused by the Bank's obvious and deliberate error or negligence. 35. FORCE MAJEURE The Bank may suspend the use of any or all banking services related to the DBS Credit Card as a result of force majeure, namely any condition caused by causes beyond the Bank's control such as business conditions, computer damage, disruption of communication systems or sabotage, or for any other reason, including natural disasters, which have a wide impact resulting in Customer data, banking services related to DBS Credit being unavailable or access to data, banking services related to DBS Credit not being found or if the implementation of banking services related to the DBS Credit Card will cause a violation of prevailing laws and regulations.
The Bank shall not be liable for any action taken in order to comply with economic sanctions or to comply with government regulations, whether in the form of laws or regulations or requests or decisions from governments, regulators or similar authorities, or agreements entered into between the Bank and government authorities or between two or more government authorities (whether laws and regulations issued by domestic or foreign governments and, in such cases, the Bank, branches, subsidiaries or other affiliates of the Bank shall not be liable)
36. TRANSFER OF RIGHTS TO BILLS The Customer agrees that the Customer's interest, obligation or responsibility cannot be transferred according to the Terms and Conditions of this Credit Card.
The Bank has the right to transfer interest, or any bills owed to the Bank according to the Terms and Conditions of this Credit Card to another person or business entity in a manner determined by the Bank at its absolute discretion. The Customer agrees to the disclosure of confidential information relating to the Customer by the Bank to potential transferees and their advisors
37. TRANSFER OF DELINQUENT CARD ACCOUNTS The Customer agrees and acknowledges the sale/transfer by the Bank to another party of delinquent Card Accounts and when the Card Account has been sold/transferred, the Card Account will be terminated and all obligations that have not been fulfilled by the Customer to the Bank in connection with the Card will be transferred to another party. The Customer agrees to establish cooperation with the Bank or transferee to enable the transfer of the delinquent Card Accounts.
38. SET-OFF The Bank has the right, with prior notification, through the method determined by the Bank and in accordance with the provisions of the prevailing laws and regulations to transfer, use, and/or debit funds in the account(s) in the name of the Customer if such account(s) is/are maintained with any branch office of the Bank, to pay off a DBS Credit Card bill that is overdue. The Customer shall be given the opportunity to pay off the outstanding payment amount within the time period as stated in the notification.
39. PROSES MEDIASI The Bank shall be obliged to receive and record every complaint, both verbal and written, from the Customer. If a complaint is submitted verbally, the complaint will be resolved within 5 (five) business days. If the Bank requires supporting documents, the Bank will ask the Customer to submit a written complaint accompanied by the necessary supporting documents
If the complaint is submitted in writing, the complaint shall be resolved no later than 10 (ten) business days after all supporting documents are fully received by the Bank and in certain conditions, may be extended for a maximum of 10 (ten) business days from that time.
The supporting documents that must be submitted by the Customer are as follows:
Identity of the Customer and/or the Customer Representative; Power of Attorney (if the Customer is represented by another party/person}: Type and date of transaction; and Problem complained about. The Bank has the right to request supporting documents other than the supporting documents that have been submitted above to the Customer, if necessary
However, the Bank may refuse to handle a complaint if there are several conditions such as the following:
The Customer is unable to complete the document requirements within the specified period of time; The previous complaint has been resolved by the Bank in accordance with applicable provisions and regulations; The complaint is not related to material, reasonable, and direct losses and/or potential losses as stated in the Credit Card Terms and Conditions; The complaint is not related to transactions in the Credit Card. 40. GOVERNING LAW AND DISPUTE RESOLUTION With regard to these DBS Credit Card Terms and Conditions and all the consequences and implementation thereof, the Customer and the Bank agree to comply with the laws of the Republic of Indonesia. In the event of a dispute, the Customer and the Bank agree to resolve the same by deliberation of discussion leading to mutual consensus. If the Customer objects to the resolution of the complaint from the Bank, the Customer and/or the Customer's representative may submit an effort for resolution by:
Facilitation; Limited Facilitation; Outside the courts of law conducted through the Alternative Dispute Resolution Institutions listed in the List of Alternative Dispute Resolution Institutions determined by the Financial Services Authority; or Through a court of law namely through the South Jakarta Court of First Instance in Jakarta or other relevant courts of law at the branch office where the DBS Credit Card is issued. The submission of settlement efforts shall refer to the provisions of the applicable regulations including the provisions of the prevailing laws and regulations

42. LANGUAGE In the event that these Terms and Conditions are available in English, the English version is only a translation and if there are differences in interpretation between the Indonesian text and the English text, the Indonesian text shall prevail.
43. COMMUNICATION The Customer agrees that the Bank may send communications in any form to the correspondence (home/office) address, and/or email address, and/or mobile/home phone number registered in the Bank's system. In the event of any changes to the data previously provided/mentioned without notification from the Customer to the Bank, the Bank will not be held responsible if the communication sent is not received by the Customer. Therefore, the Customer is required to always update their data and notify the Bank of any changes, in accordance with the provisions of Article 25.
In order to enhance the security of Customer transactions, the Bank will send an OTP (One Time Password) codes via SMS (Short Message Service) to the Customer's mobile phone number registered in the Bank's system. For notifications with regard to certain transactions, the Bank will send notifications to the Customer's email address and/or mobile phone number registered in the Bank's system.
In the event that the Customer has a Supplementary Card and does not register a mobile phone number and email address for the Supplementary Card, then transaction notifications and the OTP Code for the Supplementary Card will be sent to the mobile phone number and/or email address for the Primary Card registered in the Bank's system.
44. IMPORTANT INFORMATION In accordance with the applicable Regulation of the Minister of Finance and the provisions on the improvement related to maximum limit for Credit Card overpayment of USD50,000 (fifty thousand United States Dollars) or the equivalent in other currencies, then:
The Customer shall be obliged to make payments as stated in the Customer's Billing Statement to avoid overpayments to the Card Account amounting to USD50,000 (fifty thousand United States Dollars) or the equivalent in other currencies The Bank shall monitor the Credit Card balances periodically, to identify the Card Accounts that have an overpayment of USD50,000 (fifty thousand United States Dollars) or the equivalent in other currencies using the Bank Indonesia mid-rate which is updated monthly. The Bank shall issue a notification to the Customer via SMS or other media when there is a payment of USD50,000 (fifty thousand United States Dollars) or the equivalent in other currencies. The Customer must immediately contact the DBSI Customer Center following the notification given by the Bank to refund the overpayment to the account specified by the Customer so that the refund can be made by the Bank no later than 60 (sixty) days after such overpayment occurs. The Bank has the right to take necessary actions to ensure compliance with these provisions. 45. MISCELLANEOUS The Bank has the right to change or amend any of these Credit Card Terms and Conditions at any time with prior notification. Any such change or amendment will take effect and be binding on the Customer after being notified to the Customer in accordance with the provisions of prevailing laws and regulations. In the event that the Customer does not agree to these Credit Card Terms and Conditions, the Customer can contact the DBSI Customer Center to request the Card closure process.
The DBS Credit Card Terms and Conditions shall constitute an integral and inseparable part of the entire standard agreement with the DBS Credit Card Application and Rates and Fees on www.dbs.digibank.co.id. The terms and conditions of this Credit Card have been adjusted to the provisions of laws and regulations including the OJK provisions
